Terms & Conditions (T&C)

1. Scope & Applicability

These Terms & Conditions apply to all orders placed via the online shop &Friends (www.andfriends.at). By placing an order, you agree to these T&C in their version valid at the time of purchase.

2. Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer, but a non-binding invitation to place an order. By submitting your order, you make a binding offer to purchase the selected products. The purchase contract is concluded once you receive an order confirmation from us by email.

3. Prices & Taxes

All prices are stated in Euro (EUR) and include statutory Austrian VAT, unless otherwise stated. Shipping costs are not included in the product prices and will be displayed separately during checkout.

4. Payment & Transaction Fees

We offer the following payment methods (depending on availability):

Payment is due immediately upon conclusion of the contract.

For certain payment methods, transaction or service fees charged by the payment provider may apply. These fees (e.g. Klarna fees or currency-related transaction fees) are borne by the customer and will be clearly indicated during the checkout process where applicable.

5. Delivery & Shipping

Delivery is made to the address provided by you during the ordering process. Estimated delivery times are non-binding unless explicitly agreed otherwise.

If a product is unavailable after an order has been placed, we will inform you promptly. Any payments already made will be refunded without undue delay.

Risk of accidental loss or damage passes to the customer upon delivery of the goods.

6. Retention of Title

Goods remain our property until full payment has been received.

7. Right of Withdrawal (Cancellation Policy)

Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party designated by you (other than the carrier) takes possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by a clear statement (e.g. via email).

8. Returns & Return Policy

In addition to the statutory right of withdrawal, the following return conditions apply:

Returned items must be unused, undamaged and in their original packaging.
Products that are made to order, personalised items, gift cards, or goods that are not suitable for return for hygiene or health reasons are excluded from returns.
Natural and handmade products (e.g. dried flowers) may vary in shape, colour and size; such variations do not constitute a defect.

Please contact us by email before returning any items so we can provide further instructions.

9. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

Custom-made or personalised products
Sealed goods which are not suitable for return for health or hygiene reasons once unsealed
Gift vouchers

10. Warranty & Liability for Defects

Statutory warranty rights under Austrian law apply. In the event of a defect, you are entitled to repair or replacement. If this is not possible or reasonable, you may request a price reduction or rescission of the contract.

11. Liability

We are liable only for damages caused by intent or gross negligence. In cases of slight negligence, we are liable only for breaches of essential contractual obligations and limited to foreseeable damages.

Liability for indirect damages, consequential damages, loss of profit or non-material damages is excluded, insofar as permitted by law.

12. Data Protection

Personal data is processed in accordance with applicable data protection laws. Further details can be found in our Privacy Policy.

13. Applicable Law & Jurisdiction

Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction shall be the registered office of the company, insofar as legally permissible.

14. Final Provisions

Should individual provisions of these Terms & Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

15. Arrival & Cancellation Policy Workshop

To ensure a smooth flow and a calm environment for everyone, please note the following:

Arrival Time

Please arrive 5 minutes before the workshop starts.

We will wait up to 10–15 minutes after the scheduled start time for everyone to gather.

15 minutes after the workshop has started, the doors will be closed.

Late arrivals cannot be admitted, and no refund or voucher can be issued.

This policy helps us maintain a clear structure and a peaceful experience for all guests.

Cancellation Policy

Client Initiated:

Up to 7 days before the workshop

Your booking can be rescheduled once to another date within the next 3 months.

Up to 42 hours before the workshop

50% of the workshop price will be refunded as a voucher.

Less than 42 hours before the workshop

Unfortunately, no refund or voucher can be issued.

Alternative option

You are always welcome to send another person to attend the workshop in your place — just let us know in advance.

Business Initiated:

We reserve the right to cancel or reschedule a workshop in certain circumstances, including but not limited to insufficient bookings. Workshops will only be hosted if a minimum of two (2) participants are booked.

In the event that we must cancel a workshop—this may include last-minute cancellations—all affected participants will receive a voucher valid for a future workshop of the same type and value as originally booked.

Vouchers may be used within the next 3 Months from cancellation on the same type of workshop.

No cash refunds will be issued for workshops cancelled by us. We will notify participants as soon as possible if a cancellation is necessary.
